The convicted killer of police commissioner Colin Winchester has been refused permission to appeal an 'eviction' from his public housing property.

David Eastman will now be forced to relinquish his Canberra unit - on Jerilderie Court in Reid - after holding on to it for the past twelve years, despite not living there since 1995 when he was convicted of murder and imprisoned for life for the 1989 slaying.

The ACT Supreme Court ruled that Eastman does not have leave to appeal the 2007 decision of the ACT Residential Tenancies Tribunal which terminated his tenancy.

The court upheld the tribunal's ruling that the terms of the lease had changed - from the original Commonwealth agreement to the Residential Tenancies Act 1997 - which allowed the public housing authority to serve a notice to vacate.

The court said leave to appeal was refused because such an application was likely to fail.
